1. Introduction

Nuuky ("we," "our," or "us") is operated from Croatia and provides a global social app that helps you stay connected with your friends through moods, rooms, and real-time presence. This Privacy Policy explains how we collect, use, and protect your information when you use the Nuuky mobile application.

By using Nuuky, you agree to the collection and use of information as described in this policy. This policy complies with the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable data protection laws.

2. Information We Collect

We collect the following types of information:

Account Information

• Name and display name
• Email address
• Profile photo (if provided)
• Authentication data from Google or Apple sign-in

Usage Information

• Mood and status updates you share
• Rooms you create or join
• Friend connections and interactions
• Nudges, flares, and call requests you send or receive
• Voice audio in rooms and voice moments (processed in real-time, not stored)
• Photos shared via photo nudges
• Streak and activity pattern data

Device Information

• Device type and operating system
• Push notification tokens
• App version
• Crash reports and error logs

3. Legal Basis for Processing (GDPR)

If you are in the European Economic Area (EEA), we process your personal data under the following legal bases:

• Contract performance — Processing necessary to provide you the Nuuky service (account data, friend connections, mood sharing, rooms)
• Legitimate interest — Improving and securing our service, preventing abuse, and monitoring app stability
• Consent — Push notifications, optional profile photos, and voice participation in rooms. You can withdraw consent at any time through your device settings or by contacting us
• Legal obligation — Where we are required to retain or share data by law

4. How We Use Your Information

We use your information to:

• Provide and maintain the Nuuky service
• Connect you with your friends and display your presence
• Send push notifications for nudges, flares, and friend activity
• Enable safety features like Ghost Mode and safety anchors
• Improve and personalize your experience
• Detect and prevent abuse or violations of our terms
• Monitor app stability and fix bugs

5. Third-Party Services

We use the following third-party services to operate Nuuky:

• Supabase — Database, authentication, and backend infrastructure
• LiveKit — Real-time audio for rooms and voice moments
• Sentry — Crash reporting and error monitoring
• Expo / Firebase — Push notification delivery
• Google & Apple — Sign-in authentication

These services process data on our behalf under their respective privacy policies. We do not sell your personal information to any third party.

6. Information Sharing

Your mood, status, and presence are visible to your friends on Nuuky. Room activity is visible to room members.

We may share information with:

• Service providers that help us operate Nuuky (as listed above)
• Law enforcement when required by law
• Other parties with your explicit consent

7. Safety & Privacy Controls

Nuuky provides built-in privacy controls:

• Ghost Mode lets you become invisible to all friends temporarily
• Take a Break pauses all presence and notifications
• Safety Anchors are trusted contacts notified if you're inactive for extended periods

8. Data Storage & Security

Your data is stored securely using Supabase infrastructure with encryption in transit and at rest. We implement industry-standard security measures to protect your information, but no method of transmission over the internet is 100% secure.

9. International Data Transfers

Nuuky is operated from Croatia (EU). Your data may be processed in countries outside your own, including the United States, where our service providers (Supabase, LiveKit, Sentry) operate servers. When data is transferred outside the EEA, we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission.

10. Data Breach Notification

In the event of a data breach that poses a risk to your rights and freedoms, we will notify the relevant supervisory authority within 72 hours of becoming aware of the breach, as required by GDPR. If the breach is likely to result in a high risk to you, we will also notify you directly via email or in-app notification.

11. Data Retention

We retain your account data for as long as your account is active. You can request deletion of your account and associated data at any time by contacting us. Upon deletion, your data will be removed within 30 days, except where retention is required by law.

12. Children's Privacy

Nuuky is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will take steps to delete it.

13. Your Rights

For all users

You have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your data
• Object to or restrict processing of your data
• Data portability (receive your data in a structured, machine-readable format)

Additional rights for EEA residents (GDPR)

• Withdraw consent at any time where processing is based on consent
• Lodge a complaint with your local data protection authority (in Croatia: AZOP)
• Object to automated decision-making and profiling

Additional rights for California residents (CCPA)

• Right to know what personal information is collected, used, and shared
• Right to delete personal information
• Right to opt-out of the sale of personal information (we do not sell your data)
• Right to non-discrimination for exercising your privacy rights

14. Analytics & Tracking

We use Sentry for crash reporting and error monitoring. This collects technical data about errors and app performance but does not track your browsing activity or build advertising profiles. We do not use any advertising trackers or sell data to advertisers.

15. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes through the app or via email. Continued use of Nuuky after changes constitutes acceptance of the updated policy.
