By downloading, installing, or using Nuuky, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.
Nuuky is a social application that allows you to connect with friends through mood sharing, rooms, presence features, nudges, and flares. We reserve the right to modify, suspend, or discontinue any part of the service at any time.
You must be at least 13 years old to use Nuuky. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these terms. By using Nuuky, you represent that you meet these requirements.
You are responsible for maintaining the security of your account and all activity that occurs under it. You must provide accurate information when creating your account. You may not:

You retain ownership of content you create on Nuuky (moods, room messages, etc.). By posting content, you grant us a limited license to display and distribute it within the app to your friends and room members as intended by the features you use.
We may remove content or suspend accounts that violate these terms or that we reasonably believe are harmful to the community.
Your use of Nuuky is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review it carefully.
Nuuky provides safety features including Ghost Mode, blocking, and Safety Anchors. These features are provided as convenience tools only and come with no guarantees of reliability, timeliness, or accuracy.
Important: Safety Anchors and other safety features are not a substitute for contacting emergency services (such as 112 or 911) if you or someone you know is in danger. Nuuky is not an emergency service, does not monitor user safety in real-time, and assumes no responsibility or liability for any harm that may result from reliance on these features. You should always contact local emergency services for urgent safety concerns.
You may delete your account at any time. We may suspend or terminate your account if you violate these terms, engage in harmful behavior, or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately.
Nuuky is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Nuuky and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.

You agree to indemnify, defend, and hold harmless Nuuky, its operators, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your violation of these terms; (c) your violation of any rights of another person or entity; or (d) any content you create or share through Nuuky.
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions. For users in the European Union, nothing in these terms affects your rights under mandatory consumer protection laws of your country of residence.
Any disputes arising from these terms or your use of Nuuky shall be subject to the exclusive jurisdiction of the courts of Croatia, except where mandatory local consumer protection law requires otherwise.
Before filing any legal claim, you agree to first contact us at support@nuuky.app and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve the dispute informally, either party may proceed with legal action in the courts specified above.
For EU residents: You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
We may update these Terms of Service from time to time. We will notify you of material changes through the app. Continued use of Nuuky after changes take effect constitutes acceptance of the new terms.
